Terms of Service

Rules for using Hookline, including accounts, AI-created media, likeness permissions, acceptable use, advertising responsibility, subscriptions, credits, and liability.

1. Acceptance of these Terms

These Terms of Service form a binding agreement between you and WHIPLASH LLC, a Texas limited liability company doing business as Hookline and operating FixYourHook.com ("Hookline," "we," "us," or "our"). By creating an account, purchasing a subscription or credits, uploading content, or using Hookline, you agree to these Terms, the Privacy Policy, and the Age and Minor Safety Policy.

If you use Hookline on behalf of a company or other organization, you represent that you have authority to bind that organization, and "you" includes that organization.

2. Eligibility

You must be at least 18 years old and legally capable of entering a binding contract to use Hookline. You may not use the service if applicable law prohibits you from doing so.

Hookline offers paid subscriptions and credit purchases only to customers in the United States at launch. We may reject or cancel purchases originating outside the United States.

3. The Hookline service

Hookline provides tools for creating short video hooks, reusable creators, custom openers, and related creative assets for apps, SaaS products, and other permitted uses. Features, models, providers, formats, durations, credit costs, limits, and availability may change over time.

Hookline is an AI-assisted creative tool. Outputs may be probabilistic, imperfect, non-unique, inaccurate, unavailable, or unsuitable for your intended use. You are responsible for reviewing every output before publishing or relying on it.

4. Accounts and security

You must provide accurate account information, keep your authentication credentials secure, and promptly notify us if you suspect unauthorized access. You are responsible for activity conducted through your account or workspace to the extent permitted by law.

You may not sell, rent, transfer, or share account access in a way that bypasses plan limits, security controls, creator limits, credit requirements, or other service restrictions.

5. Your content, uploads, and likeness rights

You retain the rights you hold in content you upload. You grant Hookline and its service providers a limited, worldwide, non-exclusive license to host, copy, process, transform, transmit, and display that content only as reasonably necessary to provide, secure, support, maintain, and troubleshoot the service, comply with law, or enforce these Terms.

You represent and warrant that you have all rights, permissions, licenses, releases, and consents needed for everything you upload or instruct Hookline to use, including videos, images, logos, trademarks, music, voices, faces, likenesses, testimonials, product claims, and other third-party material.

Real-person likenesses: You may not upload or use another person's face, voice, image, or likeness unless you have clear authority and all legally required consent to use it for AI-created advertising or promotional content. You may not create deceptive endorsements, unauthorized impersonations, or content suggesting that a real person used, approved, or endorsed a product when that is not true.

You may not upload creator reference material depicting a person under 18 or use Hookline to create content depicting a minor.

6. Acceptable use and prohibited conduct

You may not use Hookline to create, upload, distribute, or facilitate content or conduct that:

  • Violates law, regulation, court order, sanctions, or another person's rights.
  • Infringes copyright, trademark, privacy, publicity, contractual, or other rights.
  • Uses a real person's likeness, voice, or identity without required authorization.
  • Creates deceptive endorsements, fraudulent testimonials, impersonation, phishing, scams, or materially misleading commercial claims.
  • Sexualizes or exploits minors, depicts sexual abuse, or otherwise creates unsafe content involving minors.
  • Contains non-consensual sexual content, intimate imagery, stalking, harassment, threats, or targeted abuse.
  • Promotes illegal drugs, unlawful weapons activity, criminal services, trafficking, or other illegal conduct.
  • Is designed to manipulate elections, impersonate candidates or officials, or create deceptive political persuasion content without Hookline's express written approval.
  • Provides deceptive or unsubstantiated medical, financial, legal, safety, earnings, or performance claims.
  • Attempts to bypass moderation, rate limits, credit systems, storage limits, access controls, or technical safeguards.
  • Introduces malware, probes systems without permission, scrapes protected service data, or interferes with service operation.

Hookline may reject, block, remove, or disable content or accounts that we reasonably believe violate these rules or create legal, safety, security, fraud, or brand-risk concerns.

7. Advertising, endorsements, and claim substantiation

You are the advertiser or publisher of content you choose to use. You are solely responsible for ensuring that your ads, claims, disclosures, testimonials, endorsements, offers, pricing, comparative claims, and targeting comply with applicable law, platform rules, and industry requirements.

You must have a reasonable basis for objective claims before publishing them. You are responsible for adding any disclosures required for sponsored content, testimonials, affiliate relationships, material connections, AI-created media, or other regulated advertising practices.

Hookline does not verify the truth, legality, substantiation, or regulatory compliance of your claims merely because the service created or assisted with the content.

8. AI outputs and ownership

As between you and Hookline, you retain your rights in your inputs. To the extent Hookline owns transferable rights in a specific output created for you, Hookline assigns those rights to you upon creation, subject to your payment obligations, third-party rights, provider terms, and applicable law.

AI-created material may not qualify for copyright, may resemble content created for other users, and may contain elements subject to third-party rights. Hookline does not guarantee exclusivity, copyrightability, trademark clearance, non-infringement, accuracy, or fitness for any particular campaign.

You are responsible for reviewing outputs and obtaining any additional clearance, releases, or professional advice needed before commercial use.

9. Subscriptions, credits, billing, and cancellation

Free credits

Eligible verified accounts may receive 3 trial credits. Trial credits expire 14 days after they are granted unless a different period is clearly shown in the product.

Paid subscription

Paid subscriptions renew automatically on the billing cycle and at the price shown at checkout until canceled. The Growth plan currently includes 20 monthly subscription credits. Monthly subscription credits reset when a new paid billing period begins, and unused monthly subscription credits do not roll over.

Top-up credits

Hookline may offer optional one-time credit packs. Any price, quantity, eligibility requirement, and other terms shown at checkout control that purchase. Purchased credits are service entitlements, not money, stored value, securities, or property, and have no cash value.

Cancellation

You may manage or cancel an active subscription through the billing portal made available in Hookline. Unless otherwise stated at cancellation, cancellation takes effect at the end of the current paid billing period.

Refunds

Except where required by law or expressly promised by Hookline, subscription fees and one-time credit purchases are non-refundable. When a qualifying technical failure occurs, Hookline may retry the task or restore a credit under the service's credit logic. That technical restoration is not a cash refund.

Taxes may apply. Stripe or another payment processor may handle payment information, invoices, receipts, and billing communications.

10. Service availability and changes

We may add, change, limit, suspend, or discontinue features, models, providers, plans, limits, retention periods, credit costs, or beta functionality. We will not intentionally change an already completed purchase retroactively in a way prohibited by law.

We do not promise uninterrupted service, specific creation times, output success rates, provider uptime, continued availability of a particular AI model, or compatibility with every advertising platform or editor.

11. Third-party services

Hookline depends on third-party services for authentication, hosting, storage, billing, and AI processing. Your use may involve Clerk, Supabase, Stripe, Replit, Runware, and AI model providers selected by Hookline. Third-party outages, moderation decisions, model changes, or provider restrictions may affect the service.

Links or integrations with third-party services do not mean Hookline controls or endorses those services. Separate third-party terms may apply.

12. Suspension and termination

We may suspend, restrict, or terminate access when reasonably necessary to address fraud, chargebacks, security threats, prohibited content, abuse, legal risk, repeated policy violations, nonpayment, attempts to bypass limits, or material harm to Hookline or others.

You may stop using Hookline at any time. Ending an account or subscription does not eliminate obligations that by their nature should survive, including payment obligations, intellectual-property provisions, disclaimers, limitations of liability, and indemnification.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOOKLINE AND THE SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE." HOOKLINE DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT.

HOOKLINE DOES NOT GUARANTEE THAT AN OUTPUT WILL BE ORIGINAL, LEGALLY PROTECTABLE, NON-INFRINGING, FACTUALLY ACCURATE, PLATFORM-COMPLIANT, CONVERSION-IMPROVING, OR SUITABLE FOR YOUR BUSINESS.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOOKLINE AND ITS OWNERS, AFFILIATES, PERSONNEL, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITIES, AD SPEND, OR CAMPAIGN PERFORMANCE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOOKLINE'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNTS YOU PAID TO HOOKLINE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.

15. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Hookline and its owners, affiliates, personnel, and service providers from third-party claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from or related to your content, your ads or claims, your use of another person's likeness or intellectual property, your violation of law or platform rules, or your breach of these Terms.

16. Disputes and governing law

Before filing a formal claim, you agree to send a written notice describing the dispute and requested resolution through the Contact page with the subject Legal Notice and allow a reasonable opportunity to resolve the matter informally.

These Terms and any dispute arising out of or relating to them or the service are governed by applicable United States federal law and the laws of the State of Texas, without regard to conflict-of-law rules. Any court proceeding must be brought exclusively in a court of competent jurisdiction in Texas, and each party consents to the personal jurisdiction of those courts, except where applicable law requires otherwise.

17. Changes to these Terms

We may update these Terms as the service or law changes. We will revise the date at the top and provide additional notice when legally required. Continued use after an update takes effect constitutes acceptance to the extent permitted by law.
